1. Agreement

These terms govern use of the Xaler platform, operated by Logiciel Tech. By creating an account, issuing an API key or calling any Xaler endpoint, you agree to them on behalf of your organisation.

2. Accounts and API keys

• Accounts are issued to businesses, not to individuals acting privately.
• You are responsible for every call made with your API key, including by your own sub-users.
• Keys must be kept secret. Tell us immediately if one is exposed and we will rotate it.
• You may not share, resell or sublicense your key without our written agreement.

3. Acceptable use

You may use the verification APIs only where you have a lawful basis and the consent required for the check. You must not:

• Submit an identifier you have no legal right or consent to verify.
• Use the service to build a general profile of a person beyond the purpose consented to.
• Attempt to bypass rate limits, billing, or the scope of the services enabled on your key.
• Use the service for any unlawful purpose, or in breach of RBI, UIDAI or bureau rules.

We may suspend a key immediately where we reasonably believe it is being misused.

4. Verification results

Xaler returns what the underlying source reports. We do not guarantee that a source is complete, current or correct, and a successful API response is not our endorsement of the underlying record. Decisions you take on the basis of a result — extending credit, onboarding a customer, declining an application — are yours alone.

5. Charges and wallet

• Calls are charged to your prepaid wallet at the rate applicable to your account at the time of the call.
• A call is chargeable when the verification source has been queried, whether or not the outcome is the one you hoped for. A technical failure on our side is not charged.
• Some services bill per record returned rather than per request; this is stated on the service page.
• Where a wallet balance is insufficient, calls will be refused until it is topped up.
• Prices may change on 30 days’ notice by email.

6. Availability

We aim for high availability but do not warrant uninterrupted service. Verification sources are third parties and may themselves be slow or unavailable. Planned maintenance will be notified in advance where practical.

7. Confidentiality and data

Each party will keep the other’s non-public information confidential. Our handling of personal data is described in the Privacy Policy, which forms part of these terms.

8. Liability

To the extent permitted by law, neither party is liable for indirect or consequential loss, or for loss of profit, goodwill or anticipated savings. Our total liability in any twelve-month period is limited to the charges you paid us in that period.

Nothing here limits liability for fraud, or for anything that cannot lawfully be limited.

9. Suspension and termination

• You may stop using the service and close your account at any time.
• We may suspend or terminate for material breach, misuse, or non-payment.
• On termination, access ends and any unused wallet balance is handled under the Refund Policy.

10. Governing law

These terms are governed by the laws of India, and the courts at our registered office have exclusive jurisdiction.
